Fireside Chat with Andrew McBride, Ex Chief Risk & Compliance Officer at Albemarle Corporation

In September 2023, Albemarle agreed to pay $218 million to settle the DOJ / SEC’s charges for FCPA offenses. Upon learning of the allegations regarding potential FCPA misconduct, Albermarle promptly retained outside counsel and forensic accountants to investigate and cooperated with the agencies’ investigations and implemented remedial measures. 

Andrew McBride joined the company several days prior to the self-report to the DOJ/SEC with a mandate to build a team and enhance the ethics & compliance program. The efforts of Andrew and his team were ultimately recognized by the DOJ and SEC, with Albemarle securing a 45 percent penalty reduction, the largest FCPA-related % reduction to date. In the NPA and supporting public comments, the DOJ noted the remediation measures undertaken by Albemarle including the use of data analytics. In a recent speech, Acting Assistant Attorney General Nicole Argentieri said:  

“Let this case be an example for companies considering how to achieve the best result under our policies”.  

Andrew McBride sits down with CW to share his insights and lessons learned about building effective compliance programs, how they can be communicated to DOJ/SEC, and recommendations for practitioners facing similar challenges.
